Terms of Service for `upd` CLI

By purchasing, downloading, installing, or using the updCommand Line Interface (CLI) tool ("the Software"), you signify that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Software.

// 1. License Grant and One-Time Fee

Upon payment of the one-time fee, you are granted a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software strictly for your personal, professional use. This is not a subscription; you are purchasing a digital license for the current version of the Software.

// 2. Assumption of Risk and User Responsibility

You expressly acknowledge and agree that your use of the Software is at your sole risk. The Software operates locally on your machine, interacting directly with your local file system, Git repositories, and locally installed third-party CLIs (such as Cursor or Claude). You take complete and absolute responsibility for:

  • Installing and executing the Software on your computer.
  • The data (including proprietary code or commit messages) that the Software extracts and processes.
  • The configuration of the Software, including any API tokens, webhooks, or configuration files you provide to it.

//3. "As Is" Disclaimer (No Warranties)

The Software is provided to you on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind.

We warrant that the Software has not been intentionally designed with malicious code, spyware, or malware. However, we do not warrant that the Software is bug-free, error-free, or will operate without interruption. Software inherently contains bugs. You acknowledge that the Software may fail to execute properly, may output incorrectly formatted text, or may fail to communicate with third-party APIs. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability and fitness for a particular purpose.

// 4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the creator(s) of upd be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including but not limited to:

  • Loss of profit, loss of revenue, or loss of data.
  • Employment or disciplinary repercussions resulting from the use of AI to generate your workplace status updates.
  • Data breaches or security incidents arising from your mishandling of Slack User Tokens or local configuration files.
  • Any damages arising from the Software's interaction with your local Git repositories or third-party AI tools.

Our total liability to you for any cause whatsoever, regardless of the form of the action, will at all times be limited to the amount paid, if any, by you for the Software license (i.e., the $29 purchase price).

// 5. Third-Party Integrations

The Software facilitates interactions with third-party services (e.g., Slack, GitHub, OpenAI, Anthropic, Cursor). We are not responsible for the availability, security, or terms of these third parties. You are solely responsible for ensuring your use of updcomplies with your employer's policies and the Terms of Service of any third-party APIs or tools you connect to the Software.

// 6. Refund Policy

We offer a 14-day money-back guarantee. If you are unsatisfied with the Software or if it fails to operate on your specific system environment, you may request a full refund within 14 days of purchase. Upon receiving a refund, your license is immediately revoked, and you must delete all copies of the Software from your devices.

// 7. Modifications to the Software

We reserve the right to modify, update, or discontinue the Software at any time. While we may provide updates or bug fixes, we are under no obligation to provide ongoing maintenance, support, or future compatibility with updates to macOS, Linux, Windows, Node.js, Slack, or local AI tools.
